The Florida Supreme Court has ruled that when independent perils converged and no single cause could be considered the sole or proximate cause of a homeowner's loss, it was appropriate to apply the concurring cause doctrine and not the efficient proximate cause rule to determine whether or not there was insurance coverage for the loss. The U.S. Court of Appeals for the Sixth Circuit, reversing a decision by a Michigan federal district court, has ruled that an excess insurance carrier was not obligated to cover settlement costs incurred by its insured where the insured had failed to obtain the insurer's consent prior to settling various product liability claims that had been filed against it.
