No Insurance Coverage for Man Who Was Not "In," "Upon," "Getting In," "On," "Out," or "Off" Insured Vehicle When He Was Injured, Louisiana Court Decides
A federal district court in Louisiana has ruled that a man who had not been "in," "upon," or "getting in," "on," "out," or "off" an insured vehicle had not been "occupying" an insured vehicle and, therefore, was not entitled to recover benefits for injuries he suffered after being struck by another vehicle. Read More

Insureds' Property Valuation in Bankruptcy Court Doomed Fire Claim They Filed One Year Later
The U.S. Court of Appeals for the Eighth Circuit, affirming a decision by a federal district court in Missouri, has ruled that a homeowners insurance policy was void where the insureds had valued their personal property at $7,000 in bankruptcy court but a year later valued it at $262,500 in a proof of loss they submitted to their insurer following a fire at their home. Read More

The Supreme Court of Illinois has ruled that private citizens were not the proper claimants on a statutorily mandated, public official bond issued by RLI Insurance Company, as surety, to the Madison County Treasurer and Collector. Read More

Oregon Appeals Court Cites Policies' Anti-Assignment Clauses to Reject Plaintiff's Claim Against Defendant's Insurer
An appellate court in Oregon, affirming a trial court's decision, has ruled that anti-assignment clauses in an insured's insurance policies prohibited the insured from assigning its rights against its insurer where the assignment occurred as a result of a settlement rather than a judgment. Read More
