The U.S. Court of Appeals for the Third Circuit, reversing a decision by the U.S. District Court for the Eastern District of Pennsylvania, has ruled that, for an insurance contract to be considered a "renewal" under applicable Pennsylvania law, it must contain the same, or nearly the same, terms as the original insurance contract. Florida Law Subjects Emergency Service Provider's Bills to Deductibles in PIP Policy, Appeals Court Rules
A Florida appellate court, reversing a trial court's decision, has ruled that where an emergency service provider submits its claims to its patient's automobile insurer within the 30-day period provided for by Florida law, those claims are prioritized for payment; however, the appellate court also decided, any such payment is subject to deductibles that exist in the patient's insurance policy.
