California Health Plans Must Provide Coverage for Applied Behavioral Analysis When Provided or Supervised by Certified Therapists Even If They Are Not Otherwise Licensed
A California appellate court has ruled that the California Department of Managed Health Care must direct health plans within its jurisdiction to provide coverage for Applied Behavioral Analysis, an intensive form of therapy often used to treat the symptoms of autism in young children, when provided or supervised by Behavior Analyst Certification Board-certified therapists who are not otherwise licensed as physicians, psychologists, or otherwise. Read More

Sixth Circuit Rules that Liquor Liability Exclusion Did Not Bar Coverage of Common Law Negligence Claim Brought against Tavern
The U.S. Court of Appeals for the Sixth Circuit, reversing a district court's decision, has ruled that a liquor liability exclusion in a commercial general liability insurance policy did not exclude coverage of a common law negligence claim brought against the insured tavern, notwithstanding that the state's Dram Shop Act apparently barred such claims. Read More
