Worker's Comp Law Struck Down in New York
An appellate court in New York has ruled that a 2013 amendment to Workers' Compensation Law § 25–a that imposed liability on private insurance companies with respect to workers' compensation insurance policies issued in New York before October 1, 2013 impermissibly imposed on the insurers significant additional liability retroactively with respect to those past contracts and was unconstitutional. Worker's Comp Commission Finding on Notice Is Upheld by South Carolina Supreme Court, Although "Reasonable Minds" Could Differ
The South Carolina Supreme Court, reversing an appellate court's decision, has ruled that a finding by the South Carolina Workers' Compensation Commission that an employee had provided timely notice to his employer of his alleged injury was supported by sufficient evidence and had to be upheld, although "reasonable minds could have reached a different conclusion based on the record."
