New York's highest court, the New York Court of Appeals, has vacated its decision in K2 Investment Group, LLC v. American Guarantee & Liability Ins. Co., which held that American Guarantee & Liability Insurance Company's breach of its duty to defend barred it from relying on policy exclusions, and now has agreed with American Guarantee that it erred in K2-I by failing to take account of a controlling precedent, Servidone Const.
