Kansas Supreme Court Rules that Insurer’s Notice of Claim to City in Amount Different from Amount It Later Sought in Litigation Substantially Complied with State Law
The Kansas Supreme Court has ruled that an insurance company’s notice of a claim to a city for one amount substantially complied with the requirements of state law even where the amount the insurer subsequently sought in the litigation that ensued was different from the amount in the notice. Read More

No Coverage Where Court Finds that Homeowners Had Not Used “Reasonable Care” to Maintain Heat in Home and Pipes Had Frozen
A federal district court in Minnesota has granted an insurer’s motion for summary judgment in a case in which the insurer denied a claim for damage to a home resulting from frozen pipes, but the court found that the homeowners had not used reasonable care to maintain the heat in the house. Read More

New York Appellate Court Upholds Insurers’ Defense Verdict in Carothers Case
An appellate court in New York has upheld the trial verdict and judgment in favor of 53 New York automobile insurers and self-insurer defendants in Andrew Carothers, M.D., P.C. v. Progressive Insurance Co., relieving the defendants of approximately $20 million in pending claims. Read More

Medicaid Act Bars California’s Elimination of Coverage for Certain Health Care Services Provided by Publicly-Funded Health Clinics, 9th Circuit Holds
The U.S. Court of Appeals for the Ninth Circuit has ruled that the Medicaid Act prohibits California from eliminating coverage for adult dental, podiatry, optometry, and chiropractic health care services provided by publicly-funded health clinics and therefore California legislation to that effect was invalid. Read More

The Financial Stability Oversight Council has voted to designate American International Group, Inc., a “systemically important financial institution.” Together with the Council’s designation of the General Electric Capital Corporation, Inc., this was the Council’s first use of its authority under Title I of the Dodd-Frank Wall Street Reform and Consumer Protection Act to subject a nonbank financial company to consolidated supervision and enhanced prudential standards. Read More
