8th Circuit: Insured's Failure to Cancel One Disability Policy Did Not Allow Insurer to Rescind Its Newer Policy
The U.S. Court of Appeals for the Eighth Circuit, reversing a decision by the U.S. District Court for the District of Minnesota, has ruled that, under applicable Wisconsin law, an insurance company could not rescind a disability insurance policy of an insured it claimed was over-insured because of his failure to cancel an existing policy at the time it issued its policy, as he had agreed to do. Read More

This Eye on the Experts article explains a recent opinion by the U.S. Court of Appeals for the Second Circuit denying a petition for rehearing by National Liability & Fire Insurance Company with respect to the court's decision issued in September in National Liability v. Aaron Itzkowitz, et al.
