A federal district court in New Jersey has denied an insurance company's motion to dismiss a coverage action based on a "conversion" exclusion in its policy in a case where a hacker allegedly obtained funds to which it was not entitled, concluding that it was not yet clear whether a "conversion" had occurred. Read More

An appellate court in Indiana, reversing a trial court's decision, has ruled that a clause in a malpractice/professional liability insurance policy "unambiguously" reserved questions of arbitrability for the arbitrator — including whether the insurer had waived its right to arbitrate the coverage dispute on the ground that its demand to arbitrate had been untimely. Read More

Widow's Bid for Life Insurance Benefits for Deceased Husband Failed Because He Was an Active-Duty Soldier — Even Though He Died While Off Base and Off Duty
The U.S. Court of Appeals for the Fifth Circuit, affirming a decision of the U.S. District Court for the Eastern District of Louisiana, has ruled that the widow of an active-duty soldier who died in a weekend motorcycle accident while off base and not on duty was not entitled to recover insurance benefits under a policy that excluded coverage for active members of the military. Read More
