Workers Compensation N.H. Supreme: Prevailing Workers’ Comp Claimant May Recover Attorneys’ Fees As Provided in Contingent Fee Agreement – Including as to Future Medical Benefits
The New Hampshire Supreme Court has ruled that a prevailing workers’ compensation claimant may be able to recover attorneys’ fees in the amount of one-third of the value of workers’ compensation benefits awarded to the claimant – including future medical benefits – as provided in the contingent fee agreement that the claimant entered into with counsel. N.D. Supreme: Widow Was Limited to Workers’ Comp Remedies Where She Did Not Allege That Employer Had Acted Intentionally to Cause Husband’s Accident, Injuries, and Death
The North Dakota Supreme Court, affirming a trial court’s decision, has ruled that the widow of a worker who died on the job could not sue his employer where she had not alleged sufficient facts to raise a genuine issue of material fact that the employer had engaged in an “intentional act with the conscious purpose” of inflicting her husband’s injuries.
