Homeowners Insurance Lawsuit Asserting Fear That Unprotected Sex May Have Led to HIV and Hepatitis Wasn't Covered by Defendant's Insurance Policy
The U.S. Court of Appeals for the Ninth Circuit has affirmed a decision by the U.S. District Court for the Northern District of California that a homeowners insurance carrier was not obligated to defend or indemnify its insured against a plaintiff's claims that she was in fear of contracting HIV and hepatitis because the insured had had contemporaneous, unprotected sex with multiple partners. An appellate court in New York has ruled that pollution exclusions precluded insurance coverage of costs to clean up damage under the Comprehensive Environmental Response, Compensation and Liability Act where that damage had been caused by lead paint and lead emissions — even if they would not have precluded coverage of costs to clean up damage caused by lead paint alone.
