Missing Quotation Marks Made "Occurrence" Ambiguous in Policy's Deductibles Provision, New York District Court Rules
A federal district court in New York has ruled that the word "occurrence" in the deductibles provision of a business owner's insurance policy was ambiguous because it did not appear in quotation marks and, therefore, that a finder of fact would have to determine whether a series of thefts should be understood as a single occurrence, subject to a single deductible, or as multiple occurrences, subject to multiple deductibles. Read More

Claim Following Employee's "Road Rage" Was Not Covered by Employer's Auto Policy, Ninth Circuit Decides
The U.S. Court of Appeals for the Ninth Circuit, affirming a decision by the U.S. District Court for the Central District of California, has ruled that an employer's commercial automobile insurance policy did not cover a pedestrian's claim for damages suffered as a result of an employee's road rage because the claim did not arise out of the "use" of the employer's vehicle.
