A federal district court in Massachusetts has ruled that an exception to a microbe exclusion in a commercial general liability insurance policy was ambiguous and that a manufacturer of flexible pouches was in the business of "food processing" for purposes of the exception and, therefore, was entitled to a defense in litigation concerning food contamination allegedly caused by the failure of its pouches.
