Alaska Supreme: Insurers May Not Recover Fees Incurred in Defending Claims Under Reservations of Rights
The Alaska Supreme Court has issued an opinion, in response to questions certified by the U.S. Court of Appeals for the Ninth Circuit, prohibiting insurance companies from recovering fees incurred in defending claims under reservations of rights.  Read More

Florida Supreme: Insurer Must Reveal Its Attorneys' Time Records to Victorious Insured in Bad Faith Case
The Florida Supreme Court, reversing a lower court's decision in an insurance bad faith case, has ruled that the hours expended by counsel for a defendant insurance company were "relevant to the issue of the reasonableness of time expended by counsel for the plaintiff," and discovery of that information, where disputed, fell within the "sound decision of the trial court."  Read More

Alabama Supreme: Insurable Interest Requirement Did Not Limit Change of Beneficiary
The Alabama Supreme Court has ruled that a validly issued life insurance policy may be modified to substitute a beneficiary regardless of whether that beneficiary had an insurable interest in the insured's life, unless the policy provided otherwise.  Read More
