The U.S. District Court for the District of New Jersey has refused to reopen a Superstorm Sandy coverage case that it had previously dismissed after what it had characterized as "months of inaction," rejecting the plaintiff's argument that his former counsel had been negligent in prosecuting his case.  Read More

N.Y. Appeals Court in Superstorm Sandy Case Rules that Policy's Deductible was $2.5 Million, Not $250,000
An appellate court in New York, reversing a trial court's decision, has ruled that the applicable deductible in a commercial property insurance policy was $2,494,020 and that the claim submitted by the insured for damage caused by Superstorm Sandy did not meet the deductible.  Read More

Policy Separately Covered Debris Removal Costs in Excess of Flood Limit, N.J. Appeals Court Rules in Superstorm Sandy Case
A New Jersey appellate court has reversed a trial court's decision in a Superstorm Sandy case and has ruled that the owner of an apartment complex damaged by Superstorm Sandy was entitled to recover over $200,000 for the costs of debris removal from its insurer in addition to the policy's $1 million limit for flood damage to its insured property.  Read More

Waiver in Bailor/Bailee Agreement Did Not Bar Insurer's Later Subrogation Action, N.Y. Appeals Court Rules in Superstorm Sandy Case
An appellate court in New York, in a Superstorm Sandy case, has reversed a trial court's decision and has ruled that a waiver of subrogation contained in an agreement between an art gallery and a bailee was not enforceable and did not bar a later subrogation action brought by the gallery's insurer against the bailee.  Read More

U.S. DOT and IIHS Announce Automakers' Commitment to Make AEB Standard on New Vehicles
The U.S. Department of Transportation's National Highway Traffic Safety Administration and the Insurance Institute for Highway Safety have announced that 20 automakers representing more than 99 percent of the U.S. auto market have committed to make automatic emergency braking a standard feature on virtually all new cars no later than September 1, 2022.  Read More
