"Held Legally Liable" in Master Insurance Policy Required a Court Holding of Liability, Georgia Supreme Court Rules
The Georgia Supreme Court, reversing a decision by an intermediate appellate court, has ruled that the phrase "held legally liable" in a master contract of insurance for a manufacturer's extended protection plan required an actual holding of legal liability by a court, not merely the possibility of such a holding or the prediction of such a holding by the insured, before the insurer could be required to indemnify the insured. CPL Policy Did Not Cover Claims Alleging that Excavation Led to Natural Gas Explosion, Appeals Court Decides
A Wisconsin appellate court, reversing a trial court's decision, has ruled that a contractors pollution liability policy did not require the insurer to defend and indemnify the insured in four consolidated lawsuits in which the plaintiffs sought recovery for bodily injury and property damage caused by a gas explosion that allegedly occurred when, during excavation, the insured's employees disturbed an underground natural gas line.
