Insurer Must Pay Interest Awarded as Part of State Court Judgment Against Insured, Plus Section 1961 Interest on that Interest, Federal Court Decides
A federal district court has ruled, after a state court judgment against the insured that provided for $1,720.20 per day in interest and after a jury verdict against the insurance company in the subsequent coverage case, that the insurer was obligated to pay the full $1,720.20 per day in interest - plus interest at the federal rate on the full amount of the judgment. A federal district court in New York has ruled that the "your work" exclusions in a commercial general liability insurance policy did not bar coverage of claims that the insured, while acting as a "construction manager," had damaged other contractors' work, although the court found that the underlying plaintiffs had a "heavy burden" to demonstrate the portion of the judgment that they had obtained against the insured that actually was covered by the policy.
