An appellate court in New York has ruled that an insurance company was not entitled to summary judgment in a coverage action because it was not clear if the insured homeowner resided at the insured property – even though the trial court in the underlying personal injury action had dismissed the complaint against the homeowner on the basis that she was an out-of-possession owner of the property. Read More
