The U.S. Court of Appeals for the Third Circuit, reversing a Delaware district court's decision in a decades-old asbestos coverage dispute, has rejected the insured's effort to rely on equitable estoppel to compel an insurance company to arbitrate where it had not signed an agreement containing an arbitration clause that other insurance companies had signed. "Intoxication" and "Under the Influence" in Liquor Liability Exclusion Were Not Ambiguous, Court Rules
A federal district court in Mississippi has ruled that the terms "intoxication" and "under the influence" in a liquor liability exclusion to a commercial general liability ("CGL") insurance policy that had been issued to a bar were not ambiguous and that, as a result, the bar's insurance carrier did not have to defend the bar against a claim that it had served a patron too much alcohol before he was involved in an automobile accident with a pedestrian.
