Idaho Supreme: Firefighter Failed to Prove That His Occupation Had Caused Him to Develop Lung Cancer
The Idaho Supreme Court has affirmed a decision of the Idaho Industrial Commission that a firefighter who developed, and then died from, lung cancer was not entitled to workers compensation and death benefits because he had not demonstrated that his occupation had caused him to develop cancer. Read More

Company That Suffered "Direct, Pecuniary Loss" from Destruction of Property It Did Not Own Nevertheless Had Insurable Interest in That Property, Michigan Appeals Court Finds
An appellate court in Michigan, reversing a trial court's decision, has ruled that an insured could have an insurable interest in property even if it did not have a legal interest in it and even if it was not financially responsible for damages to it because an insured's pecuniary interest in insured property was sufficient to constitute an insurable interest. Read More

Utah Court Denies Insurer's Request for Attorneys' Fees in Interpleader Action Involving Life Insurance Benefits Brought Against Church of Jesus Christ of Latter-day Saints and Insured's Estate
A federal district court in Utah has allowed a life insurance company that brought an interpleader action to deposit life insurance proceeds with the court — but has refused to award the insurer its attorneys' fees from the fund given that the insurer was "in the business of administering claims for life insurance benefits." Read More
