Divided Washington Supreme Court Limits Employee’s Asbestos Exposure Claim to Workers’ Compensation
The Washington Supreme Court has ruled, 5-4, that a Boeing Company employee asserting that he had been injured by exposure to asbestos was limited to recovering under the state’s workers’ compensation law where he had not demonstrated that Boeing had actual knowledge that exposure to asbestos was certain to lead to his being injured. A Wisconsin appellate court has ruled that an insurance company that failed to pay within 30 days the amount it had agreed to pay to settle a personal injury claim against its insured could be required by the trial court to pay interest on the settlement amount, concluding that “a reasonable time for payment was ‘implied.’” Read More
