The New Hampshire Supreme Court, finding that the terms “donates,” “compensation” and “at your direction” were all ambiguous, decided that a person who cleaned bathrooms for tips at a motorcycle event was a volunteer covered by an amusement park general liability insurance policy issued to the owner of the property that hosted the event. Settlement Released Insurer’s Obligation to “Preserve” Vehicle Involved in Accident, Texas Appeals Court Says
An appellate court in Texas, affirming a trial court’s decision, has ruled that the terms of a settlement agreement in two plaintiffs’ lawsuit against an insurer and its insured released the insurer’s obligation to “preserve” a vehicle involved in the underlying accident, even if that affected the plaintiffs’ subsequent lawsuit against the manufacturer of the vehicle and airbag.
