Commercial General Liability No Coverage for Environmental Cleanup Where Complaint Did Not Allege "Sudden and Accidental" Release, Second Circuit Decides
The U.S. Court of Appeals for the Second Circuit, reversing a decision by the U.S. District Court for the Southern District of New York, has ruled that an insurance company had no obligation to defend its insured under a commercial general liability insurance policy in an environmental lawsuit brought by the Commonwealth of Massachusetts where the complaint did not allege a "sudden and accidental" release of pollutants into the environment. A federal district court in Washington has ruled that a claim against the owner of a condominium unit that he had installed hard flooring in his unit without appropriate permission, causing excessive noise in the unit below and leading him to remove the flooring, did not amount to an "occurrence" under the owner's insurance policy. The Minnesota Department of Commerce has imposed a $1 million penalty against American Modern Insurance Group, with a requirement that the company provide refunds to Minnesotans who were overcharged for "force-placed" insurance on their homes.
