Professional Liability Insurance New Jersey Supreme: Law Firm LLP Did Not Convert to GP by Failing to Maintain Malpractice Insurance; Tail Coverage Not Required When Winding Down
The New Jersey Supreme Court has ruled that the requirement under New Jersey law that a law firm limited liability partnership purchase professional liability insurance did not extend to the windup period when the law firm has ceased performing legal services. In addition, the court has ruled that there was no requirement that a law firm LLP purchase tail coverage to maintain malpractice insurance beyond dissolution. Read More

Colorado Supreme: Extrinsic Evidence May Not Be Used to Find Ambiguity in Policy
The Colorado Supreme Court, reversing lower court decisions, has ruled that lienholder statements extrinsic to an insurance policy did not create an ambiguity in the policy because an ambiguity must appear in the four corners of an insurance contract before extrinsic evidence may be considered. Georgia Supreme Court Asked to Decide When an Insurer Has Properly Accepted a Settlement Offer
The U.S. Court of Appeals for the Eleventh Circuit, in a case implicating a new Georgia statute governing settlement offers for personal injury and death claims arising from motor vehicle accidents that no court has yet addressed, has asked the Georgia Supreme Court to determine whether an insurer had properly accepted a settlement offer under the statute.
