The Idaho Supreme Court has ruled that although a workers compensation claimant had been given "the runaround" about her claim by an insurance company, and although the insurer had acted "unreasonably" by delaying its decision on her claim and/or refusing to communicate with her, the claimant was not entitled to recover her attorneys' fees.   Read More

West Virginia Supreme: Fire Policy's Pollutant Cleanup Provision Did Not Apply to Asbestos in Fire-Damaged Building
The Supreme Court of Appeals of West Virginia has ruled that a pollutant cleanup and removal provision in a fire insurance policy, which covered the expense of extracting pollutants from "land or water" at the insured premises, did not apply to asbestos testing and removal where the asbestos was in the fire-damaged structure. Read More
