Mississippi Attorney General Sues State Farm for Alleged Katrina Scheme Involving Homeowner Assistance Program
Mississippi Attorney General Jim Hood has sued State Farm Fire and Casualty Company, alleging that the State of Mississippi suffered losses as a result of a scheme by State Farm to mischaracterize wind damage as flood damage when adjusting the homeowner insurance claims of thousands of Mississippians in the wake of Hurricane Katrina. Georgia Supreme: Insured Could Not Pursue Bad Faith Action Where Insurer Had Not Consented to Insured’s Settlement of Underlying Action
The Supreme Court of Georgia, in response to questions certified by the U.S. Court of Appeals for the Eleventh Circuit, has ruled that an insured was precluded from pursuing a bad faith action against its excess insurance carrier where the insured had settled an underlying action without the insurer’s consent. AD&D Policy Provided Benefits Only for Insured’s Death, Not for His Amputated Foot, Court Rules
A federal district court in Louisiana has ruled, in a case where an insured was injured, had his foot amputated, and later died from his injuries, that the beneficiaries under an accidental death and dismemberment insurance policy were entitled only to death benefits and not also to benefits for the insured’s loss of his foot.
