Rhode Island Supreme: Public Policy Did Not Require That Contractor's Former Insurer Cover Claims Allegedly Stemming from His Negligence During Policy Period
The Rhode Island Supreme Court, rejecting an analogy to uninsured motorists coverage, has ruled that a contractor's former insurance company was not obligated to cover claims allegedly stemming from the contractor's negligent construction of a deck where the alleged bodily injuries had occurred after the policy had expired – even if the construction had taken place during the policy term.  Read More

The Michigan Supreme Court, reversing an appellate court's decision, has ruled that any payment of no-fault benefits to a plaintiff before the plaintiff filed a no-fault suit satisfied the "payment" exception to the no-fault law's one year statute of limitations.  Read More

What Magic Words Are Needed for an Additional Insured to Notify the Insurer of an Occurrence? New York's Top Court Explains
New York's highest court, the New York Court of Appeals, has affirmed an appellate court's decision that an additional insured's letter to the insured amounted to notice to the insurer of an "occurrence" where it included the word "claim" and details of the claim, and requested that the insurer be notified – even though the letter did not "expressly" state that it was seeking coverage as an additional insured.  Read More
