Insurers' Filing Sets Forth Roadmap to Their Likely Defenses
Liaison counsel for insurance companies in the over 800 Superstorm Sandy insurance coverage-related cases pending in the U.S. District Court for the Eastern District of New York has filed a list of commonly occurring legal issues and defenses that the insurers anticipate may arise in the Sandy cases, along with relevant case law or other authority addressing these issues. "In Transit" Clause Covered Theft While Plaintiffs' Cash Was Being Processed at Vault, New York Appeals Court Decides
An intermediate appellate court in New York, reversing a trial court's decision, has ruled that insureds were entitled to coverage under the "In Transit" clause of an insurance bond for losses they sustained while their cash was being processed at a vault in between the Federal Reserve Bank, where it was picked up, and the insureds' check-cashing businesses and ATMs, where it was to be delivered. Judge Richard Posner of the U.S. Court of Appeals for the Seventh Circuit has written the opinion for a panel of three judges dismissing a "frivolous" appeal by a lawyer and his client from a district court order holding them in contempt in a subrogation case. Read More
