Insurance Fraud A Criminal Insurance Fraud Case Over a $360 Claim Dragged on in California for More Than Four Years Until It Was Dismissed in "Furtherance of Justice." It Then Took Another 15 Months for the Dismissal to be Affirmed
The California Court of Appeal has affirmed a decision by a San Francisco trial court dismissing, "in the furtherance of justice," three felony and three misdemeanor criminal charges against an individual arising out of his alleged submission of a single false insurance claim in the amount of $360, after the case had been pending for over four years. A federal district court in South Carolina has ruled that a plaintiff's complaint against a night club asserting that she had been shot in both legs created a "possibility" that the plaintiff's alleged injury was not excluded from coverage by the assault and battery exclusion in the insurance policy that had been issued to the night club.
