The California Court of Appeal has affirmed a decision by a San Francisco trial court dismissing, "in the furtherance of justice," three felony and three misdemeanor criminal charges against an individual arising out of his alleged submission of a single false insurance claim in the amount of $360, after the case had been pending for over four years. Appeals Court Upholds Insurer's Objection to Beneficiary's Transfer of Structured Settlement Payments
An appellate court in Oregon, applying California law, has reversed a trial court's decision and ruled that the beneficiary of a right to periodic payments under a structured settlement agreement could not transfer certain of those payments to a factoring company where the insurance company obligated to make the payments to the beneficiary objected to the transfer.
