Product Liability Plaintiffs Are Entitled to New Trial Where Ford Had "Concealed" Its Insurance Policies, Georgia Supreme Court Rules
The Georgia Supreme Court has affirmed a trial court's decision granting an "untimely" and "extraordinary" motion for a new trial by plaintiffs in a product liability lawsuit against Ford Motor Company after the trial court found that Ford had concealed its product liability insurance coverage during the trial proceedings, which had resulted in a jury verdict for Ford. An appellate court in California has affirmed a trial court's decision rejecting the lawsuit filed against a life insurance company by a divorced wife (and her children) after she discovered that her former husband had surrendered a life insurance policy before his death notwithstanding that their divorce decree had obligated him to maintain the policy for her benefit and the benefit of the children.
