Court Denies Motion to Certify Class in Case Involving Insurer's Inadequate UIM Waiver Forms
A federal district court in Pennsylvania has denied a motion for class certification in a case concerning the adequacy of certain waiver forms that Discovery Property & Casualty Insurance Company had supplied to policyholders when those policyholders had the option to accept or reject underinsured motorist benefits. The court denied the motion even though it recognized that the insurer's forms were inadequate under applicable Pennsylvania law. Read More
