Homeowners' Lender-Placed Insurance Claims Had Been Litigated in Mortgage Foreclosure Action, Appellate Court Decides
A New Jersey appellate court has ruled that homeowners' coverage claims under a lender-placed insurance policy could not be asserted in a separate lawsuit because they had been litigated in a prior mortgage foreclosure action, adding that their claims that the insurance had violated the Real Estate Settlement Procedures Act also could not be asserted in the separate lawsuit because they were time barred.
