A Florida appellate court has reversed a trial court's order denying an insurance carrier's motion to dismiss a coverage action on the ground of improper forum based on a mandatory foreign forum selection clause contained in an environmental insurance policy, finding that the owner of a Florida storage tank had not demonstrated that litigating in the New York forum required by the policy would deny it its day in court. Reversing a trial court's decision, an intermediate appellate court in New York has ruled that a police car qualified as a “motor vehicle' for purposes of determining whether a police officer who was injured in the police car, which was driven by another officer, was entitled to seek supplementary uninsured/underinsured motorist benefits under the other officer's automobile insurance policy.
