The U.S. District Court for the District of Minnesota has ruled that a crime policy did not cover returns that the insured asserted it had earned on certain of its investments but had lost through the fraud of its investment advisors, concluding that the insured had not "owned" those earnings. The U.S. Court of Appeals for the Seventh Circuit, affirming a decision by the U.S. District Court for the Southern District of Indiana, has ruled that a commercial general liability insurance policy did not provide coverage for a lawsuit alleging that the insured had recorded consumers' phone calls in the absence of allegations that the consumers' information also had been published.
