Florida Supreme: Incorrect Denial of Benefits Alone – Not Insurer Bad Faith – Permits Statutory Award of Attorneys' Fees to Insured
The Florida Supreme Court, reversing an appellate court's decision, has ruled that an insured's recovery of attorneys' fees under Section 627.428, Florida Statutes, does not require bad faith or maliciousness on the part of an insurance company in the denial of a valid claim, but only an incorrect denial of benefits. Read More
