Travelers Must Pay Over $500 Million to Johns-Manville Asbestos Plaintiffs, Second Circuit Rules
The U.S. Court of Appeals for the Second Circuit, reversing a district court's decision, has ruled that The Travelers Indemnity Company and Travelers Casualty and Surety Company must pay over $500 million to asbestos plaintiffs based on Travelers' obligations under certain settlement agreements reached in the Johns-Manville Corporation bankruptcy proceedings years ago. Read More

Benefit Unavailable to Worker When He Was Injured 40 Years Ago May Be Awarded Today, Georgia Appeals Court Rules
An appellate court in Georgia, reversing a lower court's decision, has upheld a workers' compensation board decision awarding a benefit – nurse case management services – to an employee who had been injured 40 years ago even though the benefit was not available to injured workers at the time of the employee's injury. Read More

Although Glass Had Been Installed and Store Was Stocking Up, Glass Was Not Put to Its Intended Use Until Store Actually Opened, Third Circuit Rules
The U.S. Court of Appeals for the Third Circuit, affirming a Pennsylvania district court's decision, has ruled that damage to glass that had been installed in a retail store did not constitute a products-completed operations hazard but, rather, fell under the "your work" exclusion, where the damage had occurred before the store opened to the public – even though it had taken place after stocking, inventorying, and moving into the store had begun. Read More
