Hunt Club’s Policy Did Not Cover Member Sued for Allegedly Shooting Person While Hunting, Fourth Circuit Decides
The U.S. Court of Appeals for the Fourth Circuit, affirming a magistrate judge’s decision, has ruled that a member of a hunt club who allegedly shot someone while hunting at the club was not entitled to coverage under an endorsement to the club’s commercial general liability insurance policy affording coverage to club members “with respect to [member] liability for [the club’s] activities.” Read More

Police Vehicle Is Not “Motor Vehicle” Covered by SUM Endorsement, N.Y.’s Top Court Rules
New York’s highest court, the New York Court of Appeals, reversing an intermediate appellate court’s decision, has ruled that a police vehicle is not a “motor vehicle” covered by a supplementary uninsured/underinsured motorist endorsement mandated for all “motor vehicle” insurance policies by New York Insurance Law § 3420(f)(2)(a). Read More

Jury Finds Plaintiff Did Not Suffer “Serious Injury” Under New York’s No-Fault Insurance Law
After a New York state court judge ruled that the defendant was liable for an auto accident, a jury trial was held on damages. The jury awarded no damages to the plaintiff, however, finding that the plaintiff had not suffered a “serious injury” for purposes of New York’s no-fault insurance law. Read More

A federal district court in Missouri, after a bench trial, has ruled that two homeowners had violated their insurance policy’s “Concealment or Fraud” provision and that, as a result, their policy was void.
