Wisconsin Supreme: Homeowners’ Policy Was Not “Permanent Property Insurance” for Purposes of Builder’s Risk Policy
The Wisconsin Supreme Court, reversing an appeals court ruling, has decided that the interpretation of the “permanent property insurance” condition in a builder’s risk policy was a question of law for the court, not for a jury. It then found that the condition had not been met by the homeowners’ insurance policy acquired by the home’s occupants, who were the presumptive purchasers of the home upon its completion. Read More
