Rejecting Insurer's Argument, Illinois Supreme Court Decides that Federal District Court's Erie Decision Does Not Establish a Conflict Between States' Laws
The Illinois Supreme Court has ruled that a prediction under Erie R.R. Co. v. Tompkins by a federal district court sitting in another state that the supreme court of that state would resolve a legal issue in a way that was at odds with Illinois law did not, in itself, establish an actual conflict between the two states' laws for purposes of requiring a choice-of-law analysis. Read More

Late Payment Reinstates Policy Prospectively Only, Connecticut Appeals Court Rules in Case of First Impression
In a case of first impression for Connecticut appellate courts, an appellate court in that state has ruled that when an insurance policy has been cancelled due to nonpayment of premiums, and the insured seeks to reinstate that policy, the insurer is within its rights to reinstate coverage effective only for losses going forward. Read More

The owners of 125 Broad Street in Manhattan are suing four insurance carriers in a New York state court for more than $25 million in Superstorm Sandy damages, asserting that the insurers failed to pay for the "vast majority of the losses covered" by their policies. Read More

Innocent Injured Third Party Entitled to Full Coverage under Ambulance Company's Insurance Policy, New Jersey Appeals Court Rules
An appellate court in New Jersey has ruled that an innocent injured third party was entitled to full coverage under an ambulance company's $500,000 insurance policy – the amount required by state law for ambulance companies – even though the ambulance driver who was driving when the third party allegedly was injured was not a listed driver under the policy. The appellate court rejected the insurer's contention that the limit available to the third party should be the $15,000 minimum limit for auto policies. Read More
