Motorcyclist Entitled to PIP Benefits Even Though His Motorcycle Insurer Had Not Filed Required Statutory Certification
Addressing an issue of apparent first impression, a Michigan appeals court has ruled that a non-resident motorcyclist who was involved in an accident with a motor vehicle in Michigan was entitled to personal injury protection benefits even though the insurer of his motorcycle had not filed a certification under Michigan law, where the motorcyclist was covered under an automobile policy issued by a different insurer that had filed such a certification. A federal district court in California has ruled that although an oral binder may form the basis for policy reformation and retroactive coverage, it did not, on its own, establish bad faith and, even if it constituted an oral promise, did not open the door for retroactive application of the implied covenant of good faith and fair dealing.
